My attorney by mistake has applied for my ead renewal 10 days before the 120 time frame. I was supposed to send my application to USCIS by June 20th but my attorney sent it today and did this by mistake. can the gurus please explain me my options. i would hate to miss the line for being diligent. do they reject my application and if so will they send it back. can i apply a new app before i get this application back or do i have to wait till it comes back (if it comes back). what other negative implications should i be worried about.
thanks for your advice

Can we ask for a new legislation that will allow for complete portabilty after i-140 approval? If this is achieved I don't think retrogression/insufficient Visa#'s would be a big deal.

I got GC under EB2, I'm planning to start my own business. is there any risk factors if i leave my employer right after getting GC and change the Field of intrest?
thanks
If its subway or any other franchise restaurant, then yes you can.
if its another blood sucking desi consultancy exploiting people, then No. You can never change your field of interest.

Thats ok even if she doesn't have AP. That is perfectly fine. Don't worry her H4 is already stamped and she has time till next year. She is totally safe even if she does not have AP.
Thanks chantu, She doesn't have AP, Do you think it is Safe only if she has AP ?

Can anyone be kind enough to tell me how to talk to a real person at the Vermont Service center? It has been over a month since my employer received the receipt number from USCIS, but the case cannot be found online. I tried calling the number below, but the robot that talks says the same detais that I can find online.
"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."

The lawyers did some mixup/goofup and I lost my June 2002 PD. Here is the sequence of events.
Original Labor (Labor1)
PD: June 2002
Category: EB3 (incorrectly filed at that time by lawyers)
State: CA
We didn’t hear about the whereabouts of my labor1 case because it was sent to the Backlog Processing center (all cases after May 2002 were sent)
So the lawyers suggested filing a new labor under PERM.
Second Labor (Labor2)
PD: Oct 2005
Category: EB2
Approved: in December 2005
Second I140
Approved: in December 2005/Early 2006
Received Original Labor Approval in end of Dec 2006
The lawyers decided to combine the 2 cases and file for I-485.
i.e. use the ORIGINAL Labor PD and SECOND Labor EB2.
In April 2007, 485 application was open for “EB2” – “June 2002”.
So the lawyers filed for concurrent I-485 and I-140 for the ORIGINAL EB3 case (they submitted Second Approved EB2 I-140 along with it)
ORIGINAL I-140 was approved in Oct 2007
PLEASE NOTE: the unique situation is that the SECOND I140 was approved before the ORIGINAL I140.
Since April, 2007 - We were told by my company lawyers that the 485 is under process EB2 PD June 2002.
The GC Visa number have been available for EB2 PD June 2002 for a long time now.
But we still hadn’t received our Greencard for a long time and were wondering what is causing this delay.
So after much ado by our lawyers, they agreed to check with USCIS.
Because the Second I140 was approved before the First I1-40, USCIS said that we cannot use old PD
According to our lawyers, Now our current case status is “supposedly” OCT 2005 EB2. So we lost the June 2002 PD.
Is there anyway to recapture the old PD? (with or without refilling I-485)
Any suggestions, help or insight will be greatly appreciated.
Thanks and Regards
Sam

I guess it is possible but if your H1 transfer was approved then you might have to apply for another transfer.
No, you don't have to apply for a new H1 if the previous company did cancel your H1 and the H1 has not expired. A dormant H1 can be reactivated at any time.

Here is the link that I found. Americans think h1b's are not paying taxes. Ignore it was posted.
Can Immigrants Save Social Security? By Edwin Rubenstein (http://www.zazona.com/ShameH1B/Library/Archives/SaveSS.htm)
Conclusion Text:
Foregone payroll taxes are just the tip of the iceberg. H-1bs are entitled to every social service funded by U.S. taxpayers. They use our city parks, roads, and other infrastructure. And after working six years without paying Social Security taxes many H-1bs get Green Cards, qualifying them for Social Security benefits when they retire. No effort is made to collect back payroll taxes. And what about those American workers who lose their jobs, their health insurance, and Social Security points because companies prefer the cheaper H-1bs?.
Thanks.

Are you a first time stamper OR have had a stamp before. If you have had a stamp before - read further...
I believe you can change your appointment 2 times ( or probably three times only ). You should be able to change your appointment to Delhi if dates becomes available and you are within the limit of number of changes of appointments allowed.

U R better off rescheduling your mexico appointment - its something that could be done within next 3 to 4 months for sure. The problem of rescheduled FP is, it kind of throws your case in the back and based on ASC's load, it might take them upto an year or more (think 800,000) for them to put you in again.
Its just my opinion based on my conversation with my lawyer - since we were in S. Africa and my lawyer notified me about the FP and my lawyer blurted out what I said above.
