Hello,
I would need to apply for transit visa to fly through UK. There is a UK consulate office in ATLANTA but not sure if they would give transit visa if I go in person there? Did anyone had any experience.

FYI...Anybody who has an appointment for a Visa stamping on Oct 1st at the U.S Consulate in Chennai, India, please contact the VFS office (91-44-4231-6767) to find out your new date of appointment (which the Consulate says, will be in the same week), if they have not intimated you by email already.

Obstacles to innovation in my community: I belong to the community of people who are in US on a work visa. Our main obstacle is the US laws themselves, because the present laws forbid us from doing anything on our own. If I wanted to make facebook, US laws would say, hey, go back home and come back on an EB5. Of course, we cant do that. So your laws are being ridiculous

I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
Btw, am not sure of the reason for RFE yet.
Has anyone had their 485 approved with an RFE pending on EAD or AP?

I was nice and easy few years ago which we used to get stamped here and used to say "Department of State" for the location it was stamped. I got my visa stamped once here in US.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

If the H1B is filled by his company it will be rejected. If it is filled by another company then there are no issues.

Yes, just make sure that you file all forms and pay all taxes :( even if you are not in US.

My attorney has asked to send color copies of the driver's license for 485 filing. I just now realized that I have not changed my address on the license. Will that be a problem? Is it critical to have current address on the license? Any thoughts?

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

Greeting everybody: I have been working for the same Company since 2002 first J1 then 6 years of H1-B expiring on July of this year (2009). Currently my employer is going thru the process for a Green Card with our Legal Firm and they proposed me an E Visa while the Green Card approval process is work in progress (I passed the DOL approval and I'm in the middle of the recruiting phase). I'd like to get a third party opinion if I can be granted a Green Card switching from H1-B to E Visa.
Anyone familiar with this matter?

u can retain PD only if u have Labor and I140 approved from Old Company.
When u file I-140 with new company - u dislcose intent to retain old PD as u submit copy of approved I-140 (u got with old Comapny)

Hi there.. I need some suggestions from you all. Please help.
I have applied for a green card thru my husband (we got married in Sep and applied for the green in Dec). Both of us are well qualified and are working. We submitted all the documents that are needed thru my lawyer. My finger print appotinment went fine. USCIS wanted some additional evidence for I 485 which they initially sent to us in Jan and we never received it but we followed it up and got the notice 3 weeks ago. They wanted us to submit recent tax return form (my husband's) which is 2008. For 2009 we are filing together and my husband hasnt received his K1 forms yet (he is self employed - Physical therapist) so we filed for an extension of time for filing which he usually does every year. We submitted last year's tax return (both his and mine), extension form that we submitted to IRS, additionally we submitted my W2, my pay stubs and a letter from my employer about my employment. Last week we received a denial notice for I 485, I 131 and also for travel document. The reason mentioned was we didnt submit the evidence they asked for which is federal tax return form for the most recent tax year. For us its 2008 and for 2009 we submitted the extension form. My lawyer is going to submit a motion to reopen. Any one had similar situation? Please help.

We have all the documents that they wanted. Also we are going to have a baby in AUG, so submitting a letted from my clinic too. This should be sent sometime next week.
