For my case, it looks not very easy to keep the same job title after switching employer. So I'm wondering whether anyone has the experience about how to persuade current employer not to revoke my I-140?
My situation is that the managers of quite a few departments in my current employer like me, but these managers are not getting well with each other. So I actually cannot enjoy this and am suffering the politics. And my pay is quite low, much lower than what I got in previous IT company although at that time I was a very fresh graduate, and also lower than the prevailing pay in this industry in the same city. The only reason I joined this one was for family reason.

Guys
Just curious to know whether anybody received the physical card with out a CPO email or status. Did anybody with just "Welcome" email and status receive cards yet?
Just checking whether NO CPO status/ email = no card.
I received the "Welcome" email, status and the physical letter on Tuesday but no card yet. Any body in the same boat? (I understand that it takes about 1-3 weeks but many have received cards with in a week)
The reason I am asking is my I9 expires month end and HR is on my back for the updated doc. They would rather see a card than a letter which has no expiration date :)

As per salary is concerned not much of a difference between the two contract positions. Me and and my wife are currently working but at different places. 2-3 months back we thought of moving to a big place so that the probability of the other person getting job would be more and we can stay together at the same place so I applied for Company A. They accepted my resume but because of the economy and budget constraints they hold the position and after sometime I forgot about it. I dropped the idea of moving and didn't apply for any jobs because of the current economy situations. Now last week after more than 2 months they reopened that position and interviewed me and I got the offer yesterday. Now I am in a dilemma whether to take this offer at Company A or stay where I am until the economy goes little better. My current job is stable. Added to that my wife's contract getting over in Jan 2009. I am cracking my head here thinking what's right thing to do.
Scenarios:
1. If I moved to Company A and my job is good and then after Jan my wife can look for a job at that place. (chances are more because of Big City). Everything is good.
2. If I moved to Company A and crisis is soo bad and I lost my job and from jan my wife contract is ending. After that it's just nightmare.

This question is for my friend. he has a Bcom (3 years bachlors from India) with certification of chartered accountant and cost accountant. He has a 6 years of post qualification experience in india (after ca and ) and now he has 6.5 years of experience in US. (Total post qualification experience is 11-12 years)
His lawyer said as this is a 3 years degree you dont qualify for EB2. lawyer also send us a case where DOL denied CA plus 3 years of bcom under EB2.
Can you help us if he qualify for EB-2, what is the best way to file.

I think you are required to have passport valid atleast 6months after your interview

CCC Can you please wait for a day. We are working on holding a 'All Hands' conference call. Giving financial details is on the top of the agenda. If appropiate can one of the administrators tell us how much of the funds collected thus far have been used (for whatever purposes). I am not asking where the money went :-), just basically how much is left in the Kitty now. If we are running low i am hoping we will see a spur of new donations..
Before anybody asks; yes i have contributed to IV. $600 as of now. I plan to send in another $100 or $200 by end of the month.

you can use OCT 02 EB3, file I-140, after it is approved you can port the Oct 02 PD for the EB2 application too. This way you will be current as soon as I-140 is approved, guaranteeed.
EB2 will never go behing Oct 02.

My mother came for a 6 months visit on December 10th of 2010. But she left in April of 2011 (April 9th 2011), two months short of her 6 month's stay. Can she come again in August 2011 for a six month's stay, and stay till Feb 2012? Or will she have to return in 2 months? (return by October 2011)
My mother has 10 year multiple entry visa.
I heard that a visitor can stay only 6 months in a year, is it true?
If yes, is the calendar year counted from January to december?

Is there any legal issues?
Is it a good idea?
It's a BAD idea. It has been discussed for several 100 pages, and thrown out of the window by the experts and core group.
Remember couple of things:
1. Suicide attempt is illegal in the USA
2. Satyagrah is to correct any injustcie. If there are too many people applying for GC than the available number of visas then long wait is inevitable, that's not injustice.
3. Satyagrah/hunger strike is a last resort meaning only when you run out of all other option such as Legal Battle, contacting Govt/politicians etc. Did you file a law suit yet about revised July visa bulletin?

You are right - that part of the tutorial is completely broken, and I need to modify it a bit. I am not 100% of the changes you need to make yet, but I will post an example shortly with the changes :)

I was going through the processing times bulletin which they normally release around 15th of every month and noticed that though date at top says (Posted: September 28, 2008 ) but before the list starts they have written
.................Service Center Processing Dates for Nebraska Service Center as of: July 31, 2008.
Now what is that, have they lost track of dates being considered as of today.............. I can understanb things might standstill for I-485 (dues of non availability of visa numbers), but what about I-140, for last few months it does not jumpout of that March shell.
Also what do they mean by as of July 31, 2008, can we not know someohow as of October 8th or September 28th, what cases are they considering .

There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.

When I was a PHD student I filled NIW (national interest waiver) and got my I-140 approval (priority date is 6/22/2006). Now I am working for a Telecommunication company.
My NIW I-140 form stated my job is:
SOC Code: 17-2112
Nontechnical description of job: Operations research and logistics with optimization and numerical analysis.
In my NIW cover letter, I stated my contribution in airline industry with the operations research and optimization knowledge. My current work is still related to the operations research and logistics but my contribution is different now. Does that mean I am not in the same research/work field? Some attorney said my I-485 will most probably be denied because I am not benefit to airline industry now. Is this true?
What is the definition of the same/similar field? I thought I should be safe as long as I continue to work on OR and logistics related work, even if my work on different project or for different companies.

An attorney suggested me to apply a PERM as a backup to keep the existing priority date (6/22/06), in case my NIW-based 485 case has any issue.
