Spouse 485/AP/EAD applied August 2008 (received receipt notices)

Till date I have not received my FP notice. I applied for my EAD (even though I am not planning on using it) hoping to jump start my pending 485 and get the things rolling for FP and processing of 485. Surprisingly, I got my EAD approval email on Aug 17th and I received my EAD card in the mail yesterday. It is valid for 2 years. It says finger prints not available. No change in the pending 485 status.
I am totally perplexed about receiving the EAD without FP and so is my attorney. Can someone give me an idea of what is going on? Any input is appreciated! Thanks much!

He missed the important path of "EB3-I".
He should have put one more path for EB3-I that ends like
"the petitioner is 154 years old, or dead taken to crematory by his/her great grand children while the application is in pending..."

I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.
Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

Since Senate passed the CIR bill last year, is it necessary for the Senate to pass a bill again this year?
If the House manages to pass CIR this year, wouldn't a committee (Senate & House members) meet and chalk of the difference and come to a common ground?

I think you are perfectly fine even if you don't apply EAD/AP with I-485. The only caveat, to my knowledge is that you have to wait for I-485 receipt. (correct me if I'm wrong). But based on the number of filings expected, nobody knows when you will get a receipt. Also, I think the I-485s, though filed will still be processed by priority date. The EAD/AP applications will be FIFO. So the more you delay filing them, the more time it will take for USCIS to process your EAD/AP, especially considering the number of filings expected. Based on the processing time for the I-765, which is now more than 90 days and the fact that interim EADs are not issued anymore (see below from USCIS), it is going to interesting to see how USCIS handles this.
Elimination of Interim EADs in Process (sometime in June 2006)
Under current regulations and procedures, persons who apply for EADs can go to the local USCIS offices and obtain interim EADs if the original filing takes 90 days or more. This convenience is likely to be eliminated in the near future due to USCIS concerns over the potential fraudulent use of the interim EADs. The USCIS's view is that the manufacture of EADs should occur at the Service Center level, and the expectation placed on the Service Centers is that they will process the EAD applications and manufacture the EADs within the 90-day processing period.
The USCIS acknowledged that there is a regulation in place providing for interim EADs, but note that this regulation may have to change. It seems that the antiquated machines for producing the interim EADs are going to be scrapped, eliminating the possibility of processing interim EADs at local offices, with or without the required regulatory change.

My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.

Any new recent approval for I-140 in TSC.Mine was filed on Dec 2006 and on line status is showing "Case Recieved and Pending".Still no new updates and waiting.....

I received an email from my lawyer on 26th June 2007 that they have received my approved labor certification in mail today. I got my medical examination i.e. form I-693 performed on June 23rd 2007 and received the results on June 25th 2007. I have already filed my I-485. Will it be a problem since I have got my medical test done a few days before receiving my labor certification.

Hi,
Previously worked in a Supply integration company A, and EB3 job desc shows role as a consultant "responsible for ERP implementaiton with some programming experience".
In that role later, Lets say I've performed Network and Systems Administration ALSO.
So I have a mix of all skills at the end of 10 years in the company.
Now if I get an opportunity from a company B that needs experience in Network Administration and some pre-sales (internal to the company),
1. Will I qualify to do the job and be under "same or similar category" to be AC21 compliant.
2. Can Company B file an EB2 and use porting of date.

The fingerprinting is generally scheduled to give enough time to the personnel at the center to do their job comfortably and not have a large waiting line. From my experience I found that the scheduling is loose and so the folks at the centers can accomodate an extra person very easily. Also these are contractors who get paid by the number of cases so they are okay with doing a fingerprinting if you turn up on an unscheduled day.
The best bet is to turn up on a weekday. I did this for both myself and my wife as we were headed to India the day our fingerprinting was scheduled. There was no one in line and the whole process took at most 10 minutes.

1. You cannot file I-907 yourself with the USCIS to upgrade to Premium. It has to be done through your employer or Attorney.
2. However, it is legal for you, the beneficiary, to pay for it ($1000 fee), i.e., you can write a check that is payable to the "Department of homeland security".
Form I-907 is a fairly easy form to fill. Fill it out, get it signed by your employer, and send it to the service, on behalf of the employer.
If you know the receipt number of the H-1B application, it shouldn't take you more that 20 minutes to get it all out.
PS: If the post helps you, how about contributing a fraction of that $250 to this noble cause :)

Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?
I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!
Please help.

Both of those lenses aren't the fastest, so you're going to want a sensitivity of 1600 to get acceptable shutter speeds to minimize motion blur. If the light is changing a lot, you could use aperture priority, leaving the aperture at the widest it will go (or stopped down however much you can while maintaining reasonable shutter speed).
If the light is relatively constant (and when has that happened at a concert?), you might get more consistent results from determining the correct exposure by test shots and histogram, and then leaving things set until the light changes.
If you want help with autofocus, I'm afraid that I can't help, as my Nikon is a bit older than yours (D1). :(

The substitute elimination rule is still under review and not in effect yet. The premium processing can be done with substitute labor, by attaching the original labor certification.

I was wondering if an attorney or any user with knowledge / past experience with I-485 MTR can help me understand the status of my MTR.
My story in short:
* EB2 I-485 was applied in July 07
* I -140 was approved in Aug 07 timeframe
* No change in employer, etc. Life as usual.
All of a sudden:
* Received I-485 denial on July 30, '09. No RFE no NOID. PD = Nov 06. Reason stated: underlying I-140 was not valid.
* Obvious USCIS error. I-140 is alive n kicking. So applied for MTR on Aug 14.
* Convinced my attorney to request for expedite based on USCIS error. Got a letter from TSC that the expedite was accepted on Sept 11. Attorney said I should hear in a weeks time, but the letter said within 45 days!
* On Sept 25 there was an LUD on my I-485. Status of MTR still = initial review.
* Got impatient today and called USCIS. Managed to get to level II. The courteous rep told me that on Sep 24 my I-485 was reopened for reconsideration. Online it still says 'denied'.
She also mentioned that the MTR has not been approved yet. Also that she could see a lot of activity going on with my case and someone has been assigned to it, which according to her was a good thing. God only knows what is 'good' per USCIS.
I know it will take ages for the GC, but at least the AP was coming to good use. Now I'm stuck w/o a stamped visa and unable to make business trips either. Can someone share their thoughts on what happens next, if all turns out good with my application.
